FCRA Amendment Bill, 2026: Seven Concerns Every Organisation Should Know

The FCRA Amendment Bill, 2026 is pending before Parliament. If your organisation receives foreign contributions, the changes could affect your funds, renewals and day-to-day operations.

Here is what the bill raises concerns about.

1. What happens to unspent foreign funds?

If registration is cancelled, unspent funds may go to the Consolidated Fund of India rather than back to the organisation or its donors.

2. Is the renewal process getting harder?

Renewal already involves delays and procedural friction. Critics argue the amendments do little to reduce it.

3. Can a suspension order be challenged?

The bill offers no meaningful appeal against suspension orders, leaving organisations with limited recourse while their operations are frozen.

4. What counts as “improper utilisation”?

The term is left vague. Without a clear definition, authorities get wide discretion in deciding what counts as misuse.

5. Who owns assets after revocation?

Ownership of assets acquired through foreign contributions remains unclear once registration is revoked.

6. Do suspensions stop genuine work too?

Suspension curbs can hit ongoing, legitimate programmes along with any non-compliant activity.

7. Will foreign donors step away?

The uncertainty may push foreign donors to stop engaging with Indian organisations altogether.

Key question: Can enforcement tell a non-compliant organisation apart from an inconvenient one?

What should organisations do now?

Review your current FCRA position, check unspent balances and asset records, and track the bill’s progress through Parliament.
